Terms of Service

1. About the service

DestinyKey (hereinafter — "Service", "we", "our") is a multilingual SaaS platform delivering personalized self-discovery and personality assessment reports based on astronomical birth-data calculations, available at destinykey.org and accessible in 18 languages. The Service combines Swiss Ephemeris precision astronomical computations with AI-powered content generation to produce interactive natal chart calculations, transit analysis, cyclical interpretations, and educational personality frameworks oriented toward self-knowledge and personal development.

The Service is owned and operated by a sole proprietor (Osek Patur) in the State of Israel. Contact: support@destinykey.org.

By using the Service, you accept these Terms of Service in full. If you disagree with any part of these terms, please discontinue use of the Service.

2. Nature of the service and important notice

3. User account

Access to paid features requires registration. By registering, you agree to:

• Provide an accurate, valid email address;
• Use a strong password and keep it confidential;
• Be responsible for all activity under your account;
• Notify us immediately of any unauthorized access.

By registering for the Service, you also confirm that you have read and agree to our Privacy Policy, which describes the processing of your personal data in accordance with GDPR and applicable law.

One user = one account. Transferring access to third parties, selling accounts, or using automated means to access the Service is prohibited.

You must be of legal age according to the laws of your country. Persons under 18 may use the Service only with parental or legal guardian consent.

3.1. Right to delete your account

You have the right to delete your account at any time through your account settings or by sending a request to support@destinykey.org. Upon account deletion, all personal data is deleted in accordance with our Privacy Policy (right to erasure, Article 17 of GDPR), except for data we are legally required to retain (such as tax and payment records — for statutory retention periods).

4. Subscription and payment

The Service offers three subscription tiers: Premium, Royal, and Celestial. Detailed prices and tier composition are published on the pricing page.

4.1. Subscription period

Subscriptions are billed monthly or annually. The base price is denominated in US dollars (USD); payments are processed via our payment partner (merchant of record for international payments), which may automatically convert the amount to your local currency (e.g., to New Israeli Shekels — ILS — for residents of Israel) at the prevailing exchange rate. The final amount due is displayed at checkout before payment confirmation.

4.2. Auto-renewal

Subscriptions automatically renew at the end of each period until cancelled by the user. Payment is debited from the linked card or other selected payment method.

4.3. Price changes

We reserve the right to change prices for new subscriptions. Existing subscribers retain the price at which they subscribed, for as long as they remain active payers without interruption.

4.4. Currency and conversion

All transactions are processed through our payment partner. Conversion to local currency is performed at the prevailing exchange rate of the payment partner at the time of charge. No additional commission is added by DestinyKey.

5. Founder pricing

For the first cohort of subscribers (Founder wave), the Service offers preferential pricing terms. Conditions:

• Founder pricing is available for a limited time or up to a limited number of subscribers, whichever occurs first;
• Founder status is retained for the lifetime of the active subscription — your price will not be raised by future general price increases as long as you remain an active payer without interruption;
• If you cancel and re-subscribe later, you may not be eligible to regain Founder pricing — the then-current price will apply;
• If you upgrade to a higher tier (e.g. Premium → Royal) — your Founder status is preserved, and the price is recalculated within the same wave;
• Founder pricing is not transferable to other persons and may not be assigned;
• Founder status applies to subscriptions only. One-time purchases (see Section 6) do not include Founder benefits.

6. One-time purchases

In addition to subscriptions, the Service offers one-time purchases (e.g., "One transit reading" for $8.99). Terms:

• One-time purchases are bound to a specific natal chart (date, time, place of birth) and do not transfer to other data;
• Validity is 30 days from purchase;
• One-time purchases do not grant Founder status;
• One-time purchases are not refundable once content has been generated (see Section 7.3).

7. Cancellation and refund

7.1. Subscription cancellation

You may cancel your subscription at any time via your account dashboard. Cancellation stops auto-renewal; access to paid features continues through the end of the paid period.

7.2. Subscription refund

In accordance with the EU Consumer Rights Directive (Directive 2011/83/EU) and established international practice, you may request a subscription refund within 14 (fourteen) days of the initial purchase, subject to minimal use of the service.

Refund requests beyond the 14-day period are reviewed individually by contacting support@destinykey.org.

7.3. Refund for one-time purchases

One-time purchases (e.g., "One transit reading" for $8.99) fall under digital content delivered immediately upon payment.

Accordingly, one-time purchases are not refundable after content generation. If generation failed for technical reasons (server error, service-side connectivity issue) — contact support@destinykey.org and we will refund or provide a re-generation attempt.

8. Acceptable use

You agree not to use the Service for the following purposes:

• Violation of third-party rights, including copyright and personal non-property rights;
• Distribution of offensive, discriminatory, violent, or illegal content;
• Automated or bulk data collection (scraping, crawling) without express written permission;
• Attempts to gain unauthorized access to servers, databases, or other users' accounts;
• Commercial use of the Service beyond the conditions provided by professional tiers (see Section 9.4);
• Misleading us or other users about your identity;
• Marketing the Service or its content as predictions, fortune telling, spiritual guidance, or professional advice in any field.

8.1. Fair Use Policy

Subscription tiers are designed for individual use by one person in a normal regime (including creating charts for family members, close ones, and personal reflection). To prevent abuse, a Fair Use Policy applies:

• Abnormally high activity (e.g., more than 100 interpretation generations or calculations per day from a single account) may be deemed inconsistent with the tier's intended use;
• In such cases, the Service reserves the right to temporarily limit access speed (rate limiting) or pause content generation pending investigation;
• If you are a professional consultant or plan use beyond personal scope — contact us for a separate commercial tier: support@destinykey.org.

Violation of these rules may result in warning, temporary suspension, or permanent termination of access to the Service without refund of fees paid for the remaining period.

9. Intellectual property

All materials of the Service (source code, texts, images, design, interpretation methodology) are protected by copyright and belong to DestinyKey, unless otherwise stated.

9.1. User license

The user is granted a non-exclusive, non-transferable, revocable license to use the Service within the selected tier. By default (standard consumer tiers — Premium, Royal, Celestial), the license is granted for personal use: self-knowledge, personal reflection, and work with your own chart and the charts of close persons (family members, friends, partners) on a non-paid basis.

9.2. Generated interpretations

Interpretations generated for you (reading texts, analytics, graphics) are intended for use within the selected tier. Publication of excerpts with source attribution (e.g., on social networks, in a personal blog) is permitted for non-commercial purposes.

9.3. Prohibition on resale of raw content

Systematic copying of the Service's content for resale, posting on third-party marketplaces, embedding in bots or other automated products is prohibited, regardless of the tier used.

9.4. Professional use (B2B tier)

The use of the Service's materials for commercial purposes (use within a professional consulting practice) is permitted exclusively within specialized professional tier plans.

Under a professional tier, you are granted the right to:

• Use generated text and graphic reports as supporting materials within your personal client work;
• Include the Service's data in your own branded reports with additional expert overlay (your personal interpretation and recommendations).

Under professional use, the following is prohibited:

• Direct resale of raw (unmodified) reports of the Service under your brand without your personal expert overlay;
• Providing third parties with direct access to your DestinyKey account;
• Embedding the Service's content into your own software products, chatbots, mobile apps without a separate written agreement with us.

Use of standard (consumer) tiers for commercial purposes, as well as systematic copying of content for resale without the Service's express permission, may result in warning, temporary suspension, or permanent termination of access without refund of paid fees.

10. Limitation of liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is", without any warranties, express or implied;
• We are not liable for decisions made by the user based on the Service's materials (see Section 2);
• We are not liable for indirect, incidental or consequential damages;
• The aggregate liability of DestinyKey under any claim is limited to the amount actually paid by the user for subscription or one-time purchases over the last 12 (twelve) months.

10.5. Liability to third parties

The Service bears no liability to third parties (clients of professional consultants who may use the Service) to whom a Service user provides information obtained on the DestinyKey platform.

A professional consultant using the Service under a professional tier (see Section 9.4) bears full and sole responsibility to their clients for the interpretation of data, conclusions, recommendations, and quality of consulting services provided. Any claims by end clients of a professional user are addressed exclusively in the relationship between such user and their client, without participation of DestinyKey.

11. Changes to these Terms

We reserve the right to update these Terms. We will notify registered users of material changes by email at least 30 days before they take effect.

If you continue to use the Service after the changes take effect, this means your acceptance of the updated terms. If you disagree — you may cancel your subscription as described in Section 7.

12. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. All disputes arising in connection with the Service shall be resolved in the competent courts of Tel Aviv-Yafo, Israel, except where applicable consumer law grants a user resident of another country the right to bring proceedings before a local court.
